HSE Introduce NEW Fees for Intervention (FFI’s)
FFI (Fees for Intervention) is the HSE’s (Health & Safety Executives) new cost recovery regime which was implemented from the 1st October 2012 (under regulations 23-25 of the Health and Safety Regulations 2012). These new regulations put a duty on the HSE to recover their costs for carrying out their regulatory functions if the employer is found to be in a material breach of the health and safety laws.
A material breach is when, in the opinion of the HSE inspector, there is or has been a contravention of health and safety law that requires the inspector to issue notice in writing to the duty holder.
The fee payable by the duty holder to be found in material breach of the law is £124 per hour. The total amount that can be recovered will be based on the amount of time it takes the HSE to identify and conclude its regulatory action, in relation to the material breach.
